Consumer Health Data Privacy Notice

This Consumer Health Data Privacy Notice (“Notice”) describes how Super Age Group, Inc. and its parent companies, subsidiaries, and affiliates (collectively, “Super Age”, “we”, “us”, or “our”) collects, uses, and discloses consumer health data in connection with the websites and online platforms that we operate that link to this Privacy Policy, including www.superage.com and The Super Age Standard platform (collectively, the “Site”), our email newsletters, the Super Age Games and other in-person events that we offer, our social media pages, our support and other communications, and our other online and offline services and offerings (collectively, the “Services”), and the rights available to consumers with respect to their consumer health data. 

This Notice only applies to “consumer health data” as that term is defined under applicable consumer health data privacy laws that require us to maintain this Notice, such as Washington’s My Health My Data Act or Nevada’s Consumer Health Data Privacy Law. This Notice does not govern any health-related information that is not governed by applicable consumer health data privacy laws. 

This Notice supplements the information in our general Privacy Policy and only applies to individuals from Washington, Nevada, or other states which may in the future require us to provide disclosures specific to consumer health data. If there are any differences between the practices described in our general Privacy Policy and what we explain in this Notice relating to your consumer health data, this Notice will control.

  1. COLLECTION OF CONSUMER HEALTH DATA

The categories of consumer health data we collect about you will depend on how you interact with us and the Services you engage with, as described more fully in the “PERSONAL INFORMATION WE COLLECT” section of our Privacy Policy. Several of the types of personal information listed there may include consumer health data under applicable laws, such as the following categories:

  • Individual health conditions, treatments, diseases, or diagnoses;
  • Social, psychological, behavioral, or medical interventions;
  • Health-related surgeries or procedures;
  • Use or purchase of prescribed medication; 
  • Bodily functions, vital signs, symptoms, or measurements of health information;
  • Diagnoses or diagnostic testing, treatment, or medication; 
  • Data that identifies an individual as seeking health care services; and
  • Other identifiable information that may be used to infer, derive, or extrapolate data related to the above or other health information.
  1. SOURCES OF CONSUMER HEALTH DATA

Depending on how you use the Services, we may collect consumer health data:

  • Directly from you.
  • From other sources, including third parties, our service providers, and our family of brands.
  • Automatically from your interaction with our Services.
  • From inferences we create based on the information described above.
  1. PURPOSES FOR PROCESSING CONSUMER HEALTH DATA AND HOW WE USE IT

We describe the purposes for why we process consumer health data and how we use it in the section of our Privacy Policy titled “HOW WE USE YOUR PERSONAL INFORMATION.” As further described there and subject to applicable law, we may collect and use consumer health data at your direction or with your consent, as well as for:

  • Providing, operating, improving, and analyzing the Services, including to communicate with you.
  • Research and development, including to develop new content, offerings, and services.
  • Advertising and marketing, subject to your consent where such consent is required by applicable law.
  • Compliance, fraud prevention, and safety, including for complying with applicable laws and legal orders or establishing, exercising, or defending our legal rights.
  • Creating anonymous, aggregated, or de-identified data.
  1. DISCLOSURE OF CONSUMER HEALTH DATA

We may share the categories of consumer health data described above as necessary for the purposes above with service providers, which are companies that help us operate the Services and perform functions on our behalf, such as hosting our websites, analytics, database management, and email delivery. This includes our affiliates and related companies under common corporate control.

We may also disclose consumer health data (in the same manner that we may disclose general personal information) to our professional advisors, law enforcement, government authorities, business transaction participants, or other users of the Services (such as if you make consumer health data available to others in connection with an event, or disclose consumer health data in a profile viewable by others). In addition, we may permit third parties to use cookies and similar technologies to collect consumer health data over time and across different websites while you use our Services, where permitted by applicable law. Each of these disclosures is more fully described in our general Privacy Policy.

Finally, we may also disclose consumer health data where you have provided your consent or otherwise directed us to make certain disclosures. 

  1. YOUR RIGHTS REGARDING CONSUMER HEALTH DATA

If you are covered by an applicable consumer health data privacy law, you may have certain rights with respect to your consumer health data, such as the rights described below.

  • Right to Know. The right to know if we are collecting, using, or disclosing your consumer health data, to access your consumer health data, or to receive a list of the categories of third parties with whom we have shared your consumer health data. 
  • Right to Withdraw Consent. If we are processing your consumer health data based upon consent, the right to withdraw that consent.
  • Right to Delete. The right to request that we delete your consumer health data.

Please note, these rights are not absolute and, in some cases, we may not be able to respond to your request, such as when a legal exemption applies or if we are not able to verify your identity.

If we decline to act on your request, you may appeal by following the instructions provided in our communication containing our decision or by contacting us within a reasonable period of time after we send you our decision. If your appeal is denied, you may contact the relevant government authority in your state. For Washington residents, the Washington State Attorney General may be contacted at www.atg.wa.gov/file-complaint. For Nevada residents, the Nevada State Attorney General may be contacted at https://ag.nv.gov/Complaints/CSU_Complaints___FAQ/.  

  1. CHANGES TO THIS NOTICE

We reserve the right, at any time, to modify this Notice. If we make material changes, we will update the “Last Updated” date at the top of this Notice to indicate the effective date and may send you direct notice of the update, such as where required by law. We will do this by sending you an email, posting a notice on our websites, or using other contact information that we have for you.
